Welcome to Éclat Rug ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website https://eclatrug.com/(the "Site") and any purchase of custom-made or sample products (collectively, the "Services"). By accessing the Site or using our Services, you agree to be bound by these Terms. If you disagree with any part, you may not access the Site or use our Services.

You are responsible for maintaining the confidentiality of your account and password. You agree to provide accurate and complete information. We reserve the right to suspend or terminate accounts at our sole discretion.

3.1 The process for custom rugs involves: design consultation, submission/approval of your design, creation of a Digital Proof, your final confirmation, production, and shipping.

3.2 A Digital Proof (a visual mock-up) will be sent for your final confirmation of design, colours, size, spelling, and all details. Your written approval (e.g., via email) of the Digital Proof constitutes final authorisation for us to begin production.

3.3 Once production has begun based on your approved Digital Proof, the order is non-cancelable and non-refundable, except in cases of proven manufacturing defects. Any changes requested after confirmation may incur additional fees and delays.

3.4 The Final Product will be manufactured in strict accordance with the approved Digital Proof.

4.1 Our "Premium Sample Kit" is available for a fee of €59.99.

4.2 If, after evaluating the Sample Kit, you place any subsequent order for a product, we will issue a full refund of the Sample Kit fee (€59.99) to your original payment method after the subsequent order ships.

4.3 This is a cash refund, not store credit. There is NO minimum order value required to qualify for this refund. The Sample Kit fee is non-refundable if no subsequent order is placed.

5.1 All prices are listed in Euros (€).

5.2 Shipping & Tax Policy: For orders with a total value (excluding the Sample Kit) of €59.99 or more, we cover the standard shipping cost and any applicable import VAT (Import One-Stop Shop - IOSS) for delivery within the European Union. For orders under €59.99, a flat shipping fee of €15 will be applied at checkout, and the customer is responsible for any import VAT due upon delivery.

5.3 We reserve the right to cancel any order before shipment due to pricing errors, stock unavailability, or suspicion of fraudulent activity.

5.4 You authorise us to charge the full order amount via our third-party payment processor.

6.1 Shipping costs and delivery estimates are provided at checkout. These are estimates, not guarantees. Risk of loss passes to you upon delivery to the carrier.

6.2 For orders qualifying for our IOSS service, we will remit EU import VAT. The customer is responsible for any additional customs duties or clearance fees, which are rare for rug shipments within the EU but may apply in certain cases.

7.1 Due to their custom-made nature, Custom Rugs are FINAL SALE. They cannot be returned or refunded unless they have a material manufacturing defect or significantly deviate from the approved Digital Proof.

7.2 Our Premium Sample Kit is subject to the special refund policy in Section 4.

7.3 We offer a limited warranty against material and workmanship defects for 1 (one) year from receipt. The warranty excludes damage from wear, improper care, or accidents.

8.1 All content on this Site (designs, text, logos, images) is the property of Éclat Rug or licensed to us and protected by copyright laws.

8.2 You warrant that any design, image, or text you provide for a custom rug does not infringe any third party's intellectual property rights. You agree to indemnify us against any related claims.

9.1 The Site and Services are provided "as is." We disclaim all warranties to the fullest extent permitted by law.

9.2 To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.

9.3 Our total liability for any claim related to these Terms or the Services shall not exceed the purchase price of the specific product in question.

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with applicable regulations like the GDPR.

11.1 Governing Law & Disputes: These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute, controversy, or claim arising out of or relating to these Terms shall be finally settled by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the notice of arbitration is submitted. The seat of arbitration shall be Hong Kong. The number of arbitrators shall be one. The arbitration proceedings shall be conducted in English.

11.2 Changes: We may modify these Terms at any time. The updated version will be posted on the Site with a new "Last Updated" date. Your continued use constitutes acceptance.
